The State Attorney’s Office released the results of their investigation into a shooting involving Pinellas detectives that left one man deceased in Largo. The shooting was deemed justified.

The results of the SAO investigation were released on Wednesday, June 7, 2017.

Where:
The shooting occurred in the parking lot of the Winghouse located at 7369 Ulmerton Road, Largo.

Why/How:
The State Attorney’s Office released the results of their investigation into a shooting involving Pinellas detectives that left one man deceased in Largo, on April 6, 2017.

State Attorney Bernie McCabe concluded in a letter that was sent to Sheriff Bob Gualtieri on Wednesday, June 7, 2017, stating “As a result of our investigation, I have determined that Lieutenant Steven Wagner, Sergeant Frank Holloway, Corporal Kevin Grissinger, Deputy Jason Willis, Deputy Thomas Akin, and Deputy Clay Saunders were in the performance of their legal duties when Richard Xavier-Summers defied their commands and suddenly exited from his vehicle, pointing and firing a semi-automatic firearm in their directions, committing the forcible felony of attempted murder of law enforcement officers.”

State Attorney Bernie McCabe said, “Each stated deputy was in justifiable fear that they or the other deputies would suffer great bodily harm or death had they not fired their weapons.”

The State Attorney’s Office concluded that the death of Richard Xavier-Summers was justifiable homicide, pursuant to Florida Statute 776.012.
